Craftmark Trade Ordering Portal: Terms of Use
Version: v1.0-2026-07
These Terms of Use ("Terms") govern access to and use of the Craftmark Trade Ordering Portal (the "Portal"), operated by Craftmark Pty Ltd (ABN 26 603 984 952) ("Craftmark", "we", "us"). The Portal is powered by technology provided to Craftmark by its technology supplier, Oryx Consulting Pty Ltd (the "Technology Supplier").
By creating an account, accepting these Terms in the Portal, or using the Portal, you agree to these Terms on your own behalf and on behalf of the business you represent.
1. Accounts and Access
Portal access is by Craftmark approval only. You must provide accurate account information and keep it current.
Your login is personal. Keep your credentials secure and do not share access with anyone outside your business. You are responsible for activity under your account.
Craftmark may approve, refuse, suspend or revoke access at its discretion, including where these Terms are breached.
2. Beta Service
The Portal is currently provided as a beta service. Features may be added, changed or removed, availability is not guaranteed, and errors may occur.
Craftmark may require beta participants to accept a separate Beta Participant Agreement. If there is any inconsistency, the Beta Participant Agreement prevails during the beta.
3. Quotes and Pricing
Prices, quotes and calculations produced by the Portal are indicative trade estimates only. No quote is binding on Craftmark until it has been reviewed and approved by Craftmark through the Portal’s approval workflow or otherwise confirmed in writing.
Craftmark may correct pricing errors, apply adjustments, or decline any order prior to acceptance.
You are responsible for checking quotes, dimensions, specifications and production details before submitting an order, and for the accuracy of information you enter.
Orders accepted by Craftmark are supplied under Craftmark’s standard terms of trade, available from Craftmark on request.
4. Confidentiality
The Portal and its contents, including trade pricing, discount structures, product configurations, features and workflows, are confidential to Craftmark.
You must not: (a) share, publish or disclose Portal pricing or content to any third party; (b) take or share screenshots, screen recordings or videos of the Portal; or (c) use Portal pricing to benchmark against or on behalf of any competitor of Craftmark.
Your own quote and project data remains confidential to your business, and is visible to Craftmark for the purpose of operating the service (including quote review, approval and production).
Nothing in this clause prevents you from providing your own client quotes and proposals generated from the Portal to your customers in the ordinary course of your business.
5. Acceptable Use
You must not: copy, scrape or bulk-extract Portal data; reverse engineer, decompile or attempt to access the Portal’s source code; interfere with the Portal’s operation or security; use the Portal to build or assist a competing product; or use the Portal other than for genuine quoting and ordering with Craftmark.
6. Intellectual Property and Feedback
The Portal software, including its design, source code, algorithms and all improvements, is and remains the property of the Technology Supplier. Craftmark’s branding and content remain the property of Craftmark. You receive only a right to use the Portal in accordance with these Terms.
If you provide feedback, suggestions or ideas about the Portal (including via the in-Portal feedback tool), Craftmark and the Technology Supplier may use them to operate and improve the Portal and their products without restriction, attribution or payment. You retain no rights in improvements made as a result.
7. Data and Privacy
We collect account details, quote and order data, and usage activity (including analytics) to operate, support, secure and improve the Portal.
Portal data is hosted and processed by the Technology Supplier on Craftmark’s behalf. We handle personal information in accordance with applicable privacy laws and the Portal Privacy Policy, available on this page below.
Aggregated or de-identified usage data may be used to improve the Portal.
8. Liability
To the maximum extent permitted by law, the Portal is provided "as is" and neither Craftmark nor the Technology Supplier is liable for indirect or consequential loss, loss of profits, or loss arising from: Portal errors or downtime; indicative pricing or calculation errors; or your failure to verify quotes and orders before relying on them.
This section is for the benefit of both Craftmark and the Technology Supplier, and the Technology Supplier may rely on and enforce it.
Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be excluded. Where liability cannot be excluded, it is limited to re-supply of the relevant service.
9. Suspension, Termination and Changes
Craftmark may suspend or terminate Portal access at any time, including for breach of these Terms. Sections 4, 6 and 8 survive termination. On termination you may request an export of your quote data within 30 days.
Craftmark may update these Terms from time to time. We will notify account holders of material changes (by email or in-Portal notice); continued use after notice constitutes acceptance.
10. General
These Terms are governed by the laws of New South Wales, Australia. Questions about these Terms: estimating@craftmark.com.au.
Craftmark Trade Ordering Portal: Beta Participant Agreement
Version: v1.0-2026-07
Craftmark Pty Ltd (ABN 26 603 984 952) ("Craftmark") is trialling its Trade Ordering Portal (the "Portal") with a small group of invited trade clients before wider release. In exchange for early access, you (the "Participant", on your own behalf and on behalf of the business you represent) agree to the following.
1. Beta Access
Craftmark grants the Participant early access to the Portal for genuine quoting and ordering with Craftmark, subject to this Agreement and the Portal Terms of Use.
The Portal is a beta service: features may change, break or be withdrawn, and access may be modified or ended by Craftmark at any time.
2. Confidentiality
The Portal, including its existence in beta, features, workflows, trade pricing, discounts and all content, is Craftmark confidential information.
The Participant must not, without Craftmark’s prior written consent: (a) disclose or discuss the Portal or its pricing with anyone outside the Participant’s business; (b) take, keep or share screenshots, screen recordings, photos or videos of the Portal; (c) post about the Portal on any website or social media; or (d) allow anyone outside the Participant’s business to view or access the Portal.
Nothing in this clause prevents the Participant from providing its own client quotes and proposals generated from the Portal to its customers in the ordinary course of its business.
These obligations survive for 24 months after this Agreement ends.
3. Feedback
The Participant is encouraged to provide feedback, suggestions and ideas (including via the in-Portal feedback tool).
All feedback may be used, implemented and commercialised by Craftmark and its technology supplier without restriction, attribution or payment, and the Participant claims no ownership in the Portal or any improvement arising from feedback.
4. No Reliance; No Liability
Beta pricing, quotes and outputs are indicative and may contain errors. The Participant must verify all quotes and orders with Craftmark before relying on them.
To the maximum extent permitted by law, neither Craftmark nor its technology supplier has any liability for any loss arising from the Participant’s use of, or reliance on, the beta Portal. This clause is for the benefit of both Craftmark and its technology supplier, and the technology supplier may rely on and enforce it. Rights under the Australian Consumer Law that cannot be excluded are not affected.
5. Term and General
This Agreement applies from acceptance until the Portal’s general release to Craftmark trade clients or until ended by either party on written notice. Sections 2, 3 and 4 survive the end of this Agreement.
This Agreement is governed by the laws of New South Wales. It operates alongside the Portal Terms of Use; if there is an inconsistency, this Agreement prevails during the beta.
